Zoning Board of Adjustments

Powers and Duties:

The Zoning Board of Adjustment shall have the authority, subject to the standards established in Sections 211.008 to 211.011 of the Texas Local Government Code and those established by The Comprehensive Zoning Ordinance 95-699, to exercise the following powers and perform the following duties:

Hear and decide an appeal that alleges error in an order, requirement, decision, or determination made by an administrative official in the enforcement of the Comprehensive Zoning Ordinance 95-699.
Authorize the expansion or continuation of a nonconforming use of structure.
Authorize in specific cases a variance from the terms of the Comprehensive Zoning Ordinance 95-699 if the variance is not contrary to the public interest and, due to special conditions, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the ordinance is observed and substantial justice is done.

In exercising its authority, the Zoning Board of Adjustment may reverse or affirm, in whole or in part, or modify the administrative official's order, requirement, decision, or determination from which an appeal is taken and make the correct order, requirement, decision, or determination, and for that purpose the Zoning Board of Adjustment has the same authority as the administrative official.

Number of Members:

Five (5) members and three (3) alternates

Term:

Two years

Meetings:

First Thursday of each month at 7:00 p.m., if needed, or as called by the Chairperson or requested by the City Manager or designated official.

Qualifications:

A resident of the City of Highland Village
Qualified to be a registered voter of the City of Highland Village
