Notice is hereby given that the Planning and Zoning Commission of the City of Highland Village, Texas will hold a Public Hearing on Tuesday, July 1, 2008 at 7:00 PM in the City Council Chambers, 1000 Highland Village Rd. and the City Council will hold a Public Hearing on Tuesday, July 8, 2008 at 7:30 PM in the City Council Chambers, 1000 Highland Village. Rd., Highland Village, Texas.  The purpose of the hearings is to consider an amendment to Ordinance # 95-699, as amended, and Ordinance # 99-797, a Planned Development District with Single Family -8 (SF-8) as the base zoning district known as PD-#9, Rolling Hills Estates, to rezone a twenty acre tract (known as Rolling Hills Phase II) to a Planned Development District with Single-Family 10 (SF-10) to be known as Highland Oaks PD-#11.  The 20-acre tract is located adjacent and north of Phase I of Rolling Hills Estates.  The amendment includes a new Concept Plan and Development Plan.  All persons interested are encouraged to attend this hearing.  Persons wishing their opinion to be part of the record who are unable to attend may send a written reply prior to the date of the hearing to the Highland Village Planning and Zoning Commission, c/o Sue Thompson, Community Development Manager, 1000 Highland Village Rd., Highland Village, Texas 75077 or e-mail sthompson@highlandvillage.org.

AN ORDINANCE OF THE CITY OF HIGHLAND VILLAGE, TEXAS, AMENDING ORDINANCE NO. 05-969, AS AMENDED, MARKETPLACE PLANNED DEVELOPMENT DISTRICT WITH RETAIL AS THE BASE ZONING (MPD-R), SPECIFICALLY, EXHIBIT B – 1, CONCEPT PLAN; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR NO VESTED INTEREST; PROVIDING FOR A PENALTY NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000.00); PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.

SECTION 5.  PENALTY

Any person violating or failing to comply with any provision of this Ordinance shall be fined, upon conviction, in an amount not to exceed Two Thousand Dollars ($2,000.00), and each day any violation or non-compliance continues shall constitute a separate offense.  The City may further seek injunctive relief to prohibit the continuing violation of this Ordinance.

City of Highland Village - Notice of Advertisement for Bids

1.         Sealed bids in duplicate addressed to the City of Highland Village, Texas for the 2008 Asphalt Rehabilitation Project for the City of Highland Village, Texas, hereinafter called the "City" in accordance with the plans, specifications and contract documents prepared by BW2 Engineers, Inc., will be received at the office of the City Secretary of the City of Highland Village, Texas, at 1000 Highland Village Road, Highland Village, Texas 75077, until 2:00 P.M. on July 15, 2008.  Bids received by the appointed time will be opened and read aloud.  Any bids received after closing time will be returned unopened.

 

2.         The Contractor shall identify his bid on the outside of the envelope by writing the words:

                        2008 Asphalt Rehabilitation Project

3.         Bids shall be accompanied by a cashier's check or certified check upon a national or state bank in an amount not less than five percent (5%) of the total maximum bid price payable without recourse to the City of Highland Village, or a bid bond in the same amount from a reliable surety company as a guarantee that the bidder will enter into a contract and execute a Performance Bond within ten (10) days after notice of award of contract to him.

 

4.         The Contractor’s Certificate of Insurance, which will be submitted with the Contractor’s payment bond and performance bond, shall include the following provisions:  (A) the Contractor’s Certificate of Insurance shall bind the insurance to add the City as an additional insured, (B) the certificate shall state "All policies shall be endorsed to read 'This policy will not be cancelled or non-renewed without thirty (30) days advanced written notice to the Owner and City' and ten (10) days notice for nonpayment of premiums", (C) The insurance shall be written by carriers licensed to do business in Texas and with companies with A: VIII or better rating in accordance with the current Best Key Rating Guide, and (D) the insurance shall include workers' compensation.

 

5.         Plans, specifications and bidding documents may be secured from the office of BW2 Engineers, Inc., upon payment of a non-refundable fee of thirty dollars ($30.00) per set, payable to BW2 Engineers, Inc.  BW2 Engineers, Inc. is located at 1919 S. Shiloh Road, Suite 500, Garland, Texas, 75042, (972) 864-8200.

 

6.         The right is reserved by the Mayor and the City Council as the interest of the City may require to reject any and all bids and to waive any informality in bids received.  The right is reserved by the Mayor and the City Council to select any bid that will best serve the interests of the City.

 

7.          The Bidder (Proposer) must supply all the information required by the Proposal Form.

 

8.          A Performance Bond, Labor and Material Payment Bond and Maintenance Bond will be required by the Owner; each bond shall be in the amount of 100% of the total contract amount.

 

9.           No officer or employee of the City of Highland Village shall have a financial interest, direct or indirect, in any contract with the City of Highland Village.
